ANALYSIS OF THE POSSIBILITY OF CHARACTERIZING THE CRIMINAL NONIMPUTABILITY OF THE PERSON WITH BIPOLAR I DISORDER

Abstract

This academic work proposes to articulate an analysis referring to psychological and legal aspects that concern the institute of criminal unimputability in the current Brazilian Law. There was no attempt to exhaust the theme; rather, we aimed to present a methodologically oriented panorama on the subject. The guideline of the work followed the method of qualitative scientific research in the bibliographic modality. Thus, an attempt was made to thoroughly review the specialized academic literature of Psychology and Legal Sciences to promote an appropriate theoretical articulation that allows better thinking about the institutes. The research begins with the presentation of the core meaning of unimputability for mental disorders. It then moves on to an analysis based on the meaning of mental illness in the Penal Code. In the end, it reveals the meaning of bipolar disorder and its consideration by Criminal Law. The result is embodied in a text that aims to contribute to the academic community through the proposal of didacticism inherent to the methodology adopted.
