The Judicial Recovery Of Rural Producer And Its Reflections On Brazilian Agribusiness

After the enactment of Law 11.101/2005 the judicial recovery of rural producer went through deep interpretative changes in the Brazilian courts, until the reforms brought by Law 14.112/2020. The reforms in the judicial recovery legislation simplified the access of the rural producer to this benefit and extended it to small producers, including family farmers, who can claim it regardless of previous business registration, but did not bring de condition of compliance with environmental obligations to process the request. There is ample opportunity to further research on the economic impacts of judicial recovery on Brazilian agribusiness.
