Resumo

Resumo: O presente artigo discute a possibilidade de serem penhorados, em execução trabalhista, bens gravados com alienação fiduciária. A matéria não é pacífica entre Tribunais Regionais do Trabalho de diversas regiões, sendo encontradas também divergências entre as próprias turmas do Tribunal Superior do Trabalho. A dificuldade de se pacificar a questão reside no fato de nesse tipo de lide ser contraposto bens jurídicos distintos, mas, até certo ponto, igualmente importantes, quais sejam o crédito alimentar e o direito de propriedade. Confronta-se, portanto, o direito do trabalhador de ter seu crédito adimplido, pois este diz respeito à sua própria subsistência e existência digna, e o direito do credor fiduciário, que detêm a posse do bem como garantia de pagamento. Buscando atingir os objetivos do trabalho, a metodologia de pesquisa empregada é a análise hermenêutica da legislação constitucional e processual aplicável, bem como o material bibliográfico e jurisprudencial disponível sobre o tema.

Abstract: This article aims to discuss the possibility of garnishment of goods recorded with warranty of fiduciary alienation. The matter is not pacified on the Labour Courts around the country, existing dissension in the Supreme Labour Court as well. The difficulty in the matter lies in the fact that in this type of conflict dwell two relevant legal interests, the maintenance claim and the right to property.  On one side there is the right of the worker to have his credit paid on the other side the right of the fiduciary lender to detain the possession of the good. Seeking to achieve the objectives of the study, the research methodology employed is the hermeneutical analysis of the constitutional and procedural legislation, as well as bibliographic and jurisprudential material available on the subject.
