IMUNIDADES CONSTITUCIONAIS DO PRESIDENTE DA REPÚBLICA: O Alcance das Imunidades e o Processo de Impeachment IMMUNITIES of the CONSTITUTIONAL PRESIDENT of the REPUBLIC: The scope of Immunities and the Impeachment process

Resumo

Resumo: Este artigo pretende analisar as imunidades constitucionais garantidas exclusivamente ao Presidente da República. Assim, após explicar como ocorre o processo de escolha do Chefe do Poder Executivo da União e algumas características do cargo em si, foram analisados os motivos que levaram o Poder Constituinte Originário a garantir imunidades ao Presidente. Posteriormente, foram explanadas a imunidade temporária a persecução penal e a imunidade relativa a prisão. Ainda, houve análise acerca dos crimes não abrangidos por tais imunidades para, por fim, explicar como deve ocorrer o processo de Impeachment do Chefe de Estado.

Abstract: This article analyzed the constitutional immunities granted exclusively to the President of the Republic. First, the process of choosing the President was explained along with some characteristics of the position itself. After that, the reasons that led the Legislature to guarantee immunity to the President were analyzed. Later, it was explained the temporary immunity from criminal investigation and the immunity related to from arrest. Furthermore, there was an analysis about the crimes not contemplated by such immunities, namely, the common crimes committed by reason of mandate and crimes of responsibility. Finally, it was explained the impeachment process of the President.
